Terms of Sale

These terms apply to all orders placed through www.fjkart.ca. By placing an order you agree to them. Please read them before you buy.

1. Orders

Product listings are an invitation to purchase, not a binding offer. Your order is an offer to buy. A contract forms only when we send you an order confirmation email; an automated acknowledgement of receipt is not acceptance. We may decline or cancel an order if the item is out of stock, the price or description was listed in error, we cannot verify your payment or delivery details, we suspect fraud, or we cannot deliver to your address. If we cancel an order you have already paid for, we refund you in full.

2. Pricing and taxes

All prices are in Canadian dollars (CAD). Prices shown exclude tax. Applicable GST/HST is calculated and added at checkout based on your delivery province, or on our location for in-store pickup. In New Brunswick, HST applies at the prevailing rate. Shipping charges, where applicable, are shown at checkout before you pay. If an item is listed at an obviously incorrect price, we will contact you before processing and you may cancel or confirm at the correct price.

3. Payment

Payment is due in full at the time of order. We accept the payment methods shown at checkout. Payments are processed by a third-party payment provider; we do not receive or store your full card details.

4. Delivery

We ship within Canada only. Delivery estimates given at checkout are estimates, not guarantees. We are not liable for delays caused by carriers, weather, customs, or events outside our control. Risk of loss passes to you on delivery to the address you provided. Title passes to you when we receive payment in full. If your order arrives damaged, tell us within 14 days — see our Returns and Refunds Policy. You are responsible for providing an accurate, complete delivery address; we are not liable for orders delivered to an address you entered incorrectly.

5. In-store pickup

Where offered, you may collect your order at 61 Halifax Street, Moncton, New Brunswick E1C 9R5. Pickup hours: Monday to Saturday, 9:00 a.m. to 5:00 p.m. Closed Sundays and statutory holidays. We will email you when your order is ready; bring your order confirmation and photo identification. Orders not collected within 14 days of the ready notice may be cancelled and refunded, less any restocking cost.

6. Products and warranty

The products we sell are supplied by their original manufacturers. FJ Kart Ltd. is a reseller and does not manufacture the products it sells. Products carry the manufacturer's warranty, which passes to you; terms, length and coverage are set by the manufacturer and vary by product. We will assist you in making a warranty claim. Except for the manufacturer's warranty and any warranty implied by law, we provide no additional warranty. Product images and descriptions are provided by manufacturers and suppliers; colours may appear differently on different screens and specifications may change without notice.

7. Your statutory rights

Nothing in these terms limits or removes rights you have under the Consumer Product Warranty and Liability Act (New Brunswick) or other applicable consumer protection legislation, including implied warranties as to the quality and fitness of consumer products. Where these terms conflict with those rights, those rights apply.

8. Safe use

Some products we sell may require assembly, protective equipment, or safe-operation practices, and may be subject to local rules on where they can be used. You are responsible for reading and following the manufacturer's instructions and safety warnings, using appropriate protective equipment, ensuring your intended use complies with local laws, and ensuring the product is suitable for the intended rider or user, including any age or weight limits set by the manufacturer.

9. Limitation of liability

To the extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profits, lost time, or loss of use. Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

10. Returns

Returns are governed by our Returns and Refunds Policy, which forms part of these terms.

11. Privacy

We handle your personal information in accordance with our Privacy Policy.

12. Governing law

These terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada that apply there. Disputes are subject to the courts of New Brunswick.

13. Changes

We may update these terms. The version in effect at the time you place an order governs that order.
